David Allison,
Counsel in the first trial to come before the DIFC Court, will examine the
decisions delivered by the DIFC Court which illustrate the relevance of English
principles of insolvency law and company law to litigation in the
DIFC.
Michael Todd QC will speak to company
law, again largely based on very familiar concepts to English lawyers
Andrew de La Rosa - The Trust in Gulf Jurisdictions: New
Frontier or Mirage? The trust is central to conventional collective
investment schemes and private wealth management. The appearance of trust
legislation in the Shariah and civil law-based Gulf region raises a number of
legal issues and a wider question of how suited this common law institution is
to the region's cultural as well as legal framework.
Rupert Reed will
review the jurisdiction and procedure of the DIFC Courts through the relevant
UAE, Dubai and DIFC statutes, and consider how issues arising from these
statutes have been resolved by the DIFC Courts in civil and commercial
matters.
