Which capacity test is applicable where substantial gifts are made towards the end of life, by will or by a lifetime transaction; and how decisions about gifts or statutory wills should be made on behalf of a person who has lost capacity. Recent case-law and developments in the Court of Protection will be considered.
Dr Birke Häcker -The (In)Capacity of Minors and the Reversal of Transactions They Have Entered Into
The effects, the enforceability, and the reversibility of transactions entered into by parties under age. In particular, it will seek to outline an appropriate framework of unjust enrichment liability for cases where restitutionary claims are brought by and/or against minors.
