The learning objectives are: to review the present principles of construction of private contracts and analyse how they have evolved over 20 years, in order to understand them better in practice.

The learning rationale is: to enable attendees to advise clients as to how to interpret contracts, to advise on the admissibility of evidence going to contract interpretation and to improve advocacy skills in that area.


  1. Professor Ewan McKendrick QC: Construction – where are we now?  A round-up of the present state of the authorities.
  2. Professor Timothy Endicott: Construction, implied terms and rectification, concentrating on Marks and Spencer.
  3. Nicolas Le Poidevin QC: Construction of trusts and wills.
