The limits on the exercise of contractual discretions - what are they, how do they apply in practice and how do they compare to the limits of discretions in other contexts

Chair: HHJ Waksman QC

Speakers: Tom Montagu Smith QC, James Walmsley and Professor Paul Davies

This seminar takes stock of the recent wealth of case law on the exercise of contractual discretions, in light of the Supreme Court decision in Braganza and important first instance decisions since. It examines where it leaves us, and how those limits compare to those in the public law, private trust and pensions field.
